General Conditions of Sale for Online Purchases on the DesireVibe Site

Ownership of the Site

The websitewww.desirevibe.com is owned by URSU'S E-SHOP DI ALEXEI URSU, VAT number: 04501720249. Its purpose is the online sale of products through the site.

General notes

These general conditions of sale are regulated by the Consumer Code (Legislative Decree no. 206/2005) and by the new provisions of Legislative Decree no. 21/2014, transposing European Directive 83/2011. They apply exclusively to the distance selling of the products displayed on the website. The contract stipulated between the Customer and URSU'S E-SHOP OF ALEXEI URSU will be governed in accordance with Italian law.

Acceptance of the Conditions of Sale

By placing an order on the site, the customer declares to have accepted and fully accepts the general conditions of sale and payment methods. These conditions, combined with the delivery and payment method, constitute an integral part of the sales contract between URSU'S E-SHOP DI ALEXEI URSU and the Customer.

Offer to the Public and Prices

The products and related prices on the Site constitute an offer to the public. The conditions of this offer apply exclusively to purchases made on the Site. Prices include VAT. Delivery costs, if indicated, are the responsibility of the Customer. URSU'S E-SHOP BY ALEXEI URSU reserves the right to change prices without notice.

Special offers

For special offers at temporary discounted prices, shipping/delivery times may extend up to a maximum of 7-10 days.

Orders

Orders are placed online by selecting the desired products on the site and completing the purchase procedure, including filling in all the required fields. The order is considered completed once a confirmation email is received from DesireVibe, which will include the order details and the data provided by the Customer.

Order cancellation

The Customer can cancel the order before shipping. In case of advance payment, URSU'S E-SHOP BY ALEXEI URSU. will make a full refund at no additional cost.

Terms of payment

All orders are payable in euros, taxes and mandatory contributions included. Any bank charges will be borne exclusively by the customer (even in the event of a refund). Customers can choose from several payment options, each designed for security and convenience:

  1. PayPal : This option allows fast and secure payments using only the email address and password chosen when registering on PayPal. This method does not require you to enter your credit card details with each purchase and ensures rapid order processing.
  2. Credit card : In cases of purchasing goods with a credit card payment method, upon conclusion of the online transaction, the relevant issuing company will authorize the commitment only of the amount relating to the purchase made. The amount relating to the goods processed, even partially, will actually be charged to the Customer's credit card only upon communication to URSU'S E-SHOP DI ALEXEI URSU, by the courier, of the physical delivery of the ordered goods. At no time during the purchase procedure is URSU'S E-SHOP DI ALEXEI URSU able to know the information relating to the buyer's credit card, transmitted via a secure connection directly to the website of the card issuing company that manages the transaction. No computer archive of URSU'S E-SHOP DI ALEXEI URSU will retain such data. Under no circumstances can URSU'S E-SHOP DI ALEXEI URSU be held responsible for any fraudulent or improper use of credit cards by third parties, upon payment of products purchased on the Site,
  3. Cash on delivery (Cash on delivery) : For those who prefer to pay upon receipt, we offer the option of cash payment directly to the courier. This service includes an additional cost for money management. It is important to note that although cash on delivery is often perceived as more secure, PayPal and credit cards still offer the option to dispute payments after receiving the goods.
  4. Bank Transfer : For those who prefer traditional methods, the bank transfer must be made before shipping the goods. The Customer is obliged to make the transfer within 3 days of confirming the order. Bank transfer details will be provided at the time of purchase. In the absence of notifications within the established three days, the order will be considered null and the product put back on sale. Please note that this method may slow down delivery times.

 

In any case, it is essential to choose the payment method that best suits your needs.

Delivery methods

Deliveries are made via BRT or SDA courier only in Italy. In case of absence of the Customer, the courier will leave a written note. The order will be shipped within 12/24 hours from the date of confirmation of the same and completely anonymous.

Right of Withdrawal and Exchange of Goods

The Customer is a "Consumer", as defined in article 3 of the Consumer Code, he is entitled to the rights referred to in articles 52 et seq. of the Consumer Code, as amended by Legislative Decree dated 02/21/2014 n.21 has the right of withdrawal within 14 calendar days of receipt of the goods. Products cannot be returned for hygienic or personalized reasons. The exchange of goods is possible within 14 working days of receipt. This right can be exercised in total or partial form (only some of the products purchased).

The Customer can exercise this right by communicating his wish to withdraw by sending an email to ufficioclienti@desirevibe.com indicating name, surname, order number and IBAN for any refund. The right of withdrawal can be exercised no later than 14 (fourteen) working days from receipt of the goods.

The shipping cost for returning the goods is fully borne by the Customer. Furthermore, the cost of shipping and any other costs will not be refunded: delivery by appointment, costs for cashing on delivery, etc.

Once the goods have been received, also containing the invoice, URSU'S E-SHOP DI ALEXEI URSU will verify the integrity of the same and subsequently provide a total or partial refund.

ATTENTION: The right of withdrawal does not apply to:

  • Clothing without original packaging or tampered packaging or underwear without original packaging or worn;

In confirmation of the art. 59 letter "e" of Legislative Decree 21 of 02/21/2014, the right of withdrawal cannot be exercised for goods that are not suitable for return for reasons of hygiene or health protection.   • damage to the product caused not by transport

In case of defective or damaged products, after providing proof (photos and videos of the product); this will be refunded or replaced, based on your preference. The exchange of the goods may take place no later than 14 (fourteen) working days from the date of receipt of the goods for the following reasons:

  • the item of clothing or shoe needs to be replaced in size;
  • the goods have a manufacturing defect;
  • desire to replace the item with another item;
  • the goods are on promotion;

The methods of communication and costs to be borne are the same as those for the right of withdrawal indicated above.

Responsibility

URSU'S E-SHOP BY ALEXEI URSU declines all responsibility for damages or losses, direct and/or indirect, resulting from delayed or non-delivery of the products. From any inaccuracies in the product descriptions reported on the website www,desirevibe.com or in the documentation in general.

URSU'S E-SHOP BY ALEXEI URSU is not responsible for the actions of third parties who. As independent auxiliaries, they intervene in the management or execution of payment or reimbursement operations.

URSU'S E-SHOP BY ALEXEI URSU will not be responsible for the consequences resulting from a defective product if the defect is due to the conformity of the product to a mandatory legal norm or to a binding provision, or if the state of scientific and technical knowledge, at the time in which the manufacturer put the product into circulation, did not yet allow the product to be considered defective.

URSU'S E-SHOP BY ALEXEI URSU will not be responsible if the Customer, aware of the product defect and the danger, has voluntarily exposed himself to it. Likewise, defects deriving from the bad and/or incorrect products purchased, from external causes (e.g. impacts, falls, etc.), from carelessness and improper use are not attributable to the responsibility of URSU'S E-SHOP BY ALEXEI URSU. .

The use of products purchased on the site is at the discretion of the Customer.

Jurisdiction

Any dispute will be referred to the exclusive jurisdiction of the Court of Vicenza.
